Terms of Service (ArtfyAI.com)

These Terms of Service (“Terms”) govern your access to and use of ArtfyAI.com (“ArtfyAI”, “we”, “us”, “our”), operated by Artfy AI, LLC (Delaware, USA). By accessing or using the website or services, you agree to be bound by these Terms.
1) Eligibility (Adults Only)
ArtfyAI is intended for users 18 years of age or older. By using the service, you represent that you are at least 18.
2) Account & Security
- You may need to create an account to use certain features.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You agree to provide accurate information and keep your account information updated.
3) The Service
ArtfyAI provides AI-powered tools that transform user-submitted photos into artistic-style images. Outputs may vary based on photo quality, selected style, and model behavior.
4) User Content & Permissions
You represent and warrant that:
- You own or have the necessary rights and permissions to upload and use any photo or content you submit, including rights to any person’s likeness appearing in the photo.
- Your content does not violate any law, regulation, or third-party rights (including copyright, trademark, privacy, or publicity rights).
5) Prohibited Use
You agree not to use the service to upload, generate, request, or share content that is:
- Illegal, fraudulent, or harmful
- Sexually explicit (NSFW) or exploitative
- Hateful, harassing, threatening, or violent
- Infringing or unauthorized (copyright/trademark or other IP violations)
- Intended to impersonate others, deceive, or violate privacy rights
We may suspend or terminate accounts that violate these Terms.
6) Image Processing, Privacy & Storage
- Your uploaded photo is processed to provide the requested generation output.
- Original uploaded photos are deleted within 24 hours for privacy and security.
- Generated portraits may be stored in your private “My Gallery” so you can access and download them later. You may delete generated portraits from your account (or request deletion by contacting support).
- We do not use your uploaded photos or generated portraits for marketing without your explicit consent.
7) Payments, Credits, and Subscriptions
- The service may offer credit packs and/or subscriptions.
- Subscription billing may renew automatically unless canceled before renewal.
- Payments are processed by third-party providers (e.g., Stripe).
8) Refund Policy
Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.
9) Commercial Use License
Unless otherwise stated on the pricing page:
- Pro, Ultimate, and Studio Pro plans include a commercial-use license for images you generate on the service, subject to these Terms.
- Basic/Free access (if offered) is for personal, non-commercial use only.
You are responsible for ensuring your use complies with applicable laws and third-party rights.
10) AI Limitations & Disclaimer
You acknowledge that AI-generated content may be unexpected, inaccurate, or may not meet your personal expectations. The service is provided “AS IS” and “AS AVAILABLE” to the maximum extent permitted by law.
11) Intellectual Property
- ArtfyAI owns the website, branding, design, and underlying platform (excluding user content).
- You may not copy, resell, reverse engineer, or exploit the service except as allowed by these Terms.
12) Termination
We may suspend or terminate your access to the service if you violate these Terms, if we suspect abuse or fraud, or for security/legal reasons. You may stop using the service at any time.
13) Limitation of Liability
To the maximum extent permitted by law, ArtfyAI and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the service.
14) Indemnification
You agree to defend, indemnify, and hold harmless ArtfyAI from any claims, damages, liabilities, and expenses arising from:
- your uploaded content,
- your use of the service,
- your violation of these Terms, or
- your violation of any third-party rights.
15) Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.
16) Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and update the Effective Date.
